Terms of Service

These terms are an agreement between you and Unspend Pte Ltd ("we", "us"), a company incorporated in Singapore, and they govern your use of the Embraces AI companion app at app.embraces.ai and the embraces.ai website. By creating an account or using the service, you agree to these terms. Our Privacy Policy explains what data we collect and how we use it.

Eligibility¶

Embraces AI is for adults only. You must be at least 18 years old (or the age of majority where you live, if higher) to use the service. By using Embraces, you confirm that you meet this requirement.

What Embraces is¶

Embraces AI lets you create and text with AI Companions. Companions are artificial intelligence, not real people. Their messages, selfies, wefies, and voiceovers are generated by machine-learning models: they are fiction, they can be wrong, and they are not a substitute for professional advice of any kind, including medical, mental-health, legal, or financial advice. If you are in crisis or thinking about harming yourself, please contact your local emergency services or a crisis helpline rather than a Companion.

Your account¶

Keep your credentials secure and your account information accurate. Your account is for you alone: you are responsible for everything that happens under it, and you may not share, sell, or transfer it.

Messages, subscriptions, and billing¶

Embraces uses message-based pricing. A reply from a Companion draws from your Messages balance, and some features (such as selfies, wefies, and voiceovers) draw more than one Message. New accounts receive a one-off batch of free Welcome Messages, which we may change or withdraw for new signups at any time.

Subscriptions renew automatically each billing period until you cancel, and cancellation takes effect at the end of the current period. Top-ups are one-time purchases. Prices may change; we will give you notice before a change affects an active subscription. Except where the law requires otherwise, fees are non-refundable.

Your content and the Companions you create¶

You keep ownership of the content you create on Embraces: the messages you send, the Companions you design (their names, personas, backstories, and images), and the photos you upload. You grant us a licence to host, store, process, reproduce, and display that content as needed to run the service, including sending it to the AI providers that generate replies and media, as described in our Privacy Policy.

You are solely responsible for the content you create and upload. You represent and warrant that you have all rights necessary to it, and that it does not infringe anyone's intellectual property, privacy, or other rights. Only upload photos of yourself, or of people who have clearly given you permission.

Fictional characters and intellectual property¶

Companions are user-generated works of fiction. A Companion that resembles a real person, or a character from a book, film, game, show, or other media, in name, appearance, or personality, is fan-made fiction created by a user. It is not the real person or character, and it is not affiliated with, endorsed by, or sponsored by any person, rights holder, studio, or brand unless we say so explicitly.

We do not review Companions before they are created, and hosting a user-created Companion does not mean we endorse it or claim any right to the underlying character or likeness. If you are a rights holder, or a person whose name or likeness is being used without consent, contact us at the address below and we will review and, where appropriate, remove the content: see "Intellectual property complaints" for how.

We may modify, restrict, or remove any Companion or content at our discretion, including in response to a complaint.

Acceptable use¶

Do not use Embraces to:

• create or request any sexual content involving minors, or Companions presented as minors, in any form;
• upload photos of another person without their permission, or use the service to generate imagery of a real person without their consent;
• create a Companion designed to deceive others into believing they are communicating with a real person, or use the service for fraud, scams, or harassment;
• knowingly infringe someone's intellectual property, privacy, or publicity rights;
• pursue anything illegal, including threats, incitement, or the facilitation of crime;
• probe, overload, scrape, reverse-engineer, or otherwise interfere with the service, or access it by any means other than the interfaces we provide; or
• resell the service or use it to build a competing dataset or product.

We may suspend or terminate accounts that break these rules.

Intellectual property complaints¶

If you believe content on Embraces infringes your copyright, trademark, or other rights, or uses your name or likeness without consent, email support@embraces.ai with:

• an identification of the work or right you believe is infringed;
• a link to or description of the content on Embraces you are complaining about;
• your name and contact details;
• a good-faith statement that the use is not authorised by you, the rights holder, or the law, and that your notice is accurate; and
• your physical or electronic signature.

We review complaints promptly, remove or disable content where appropriate, and may terminate the accounts of repeat infringers. We may pass your notice to the user who posted the content.

Our intellectual property¶

The Embraces service itself, including its software, design, branding, and everything we make available other than user content, belongs to us or our licensors. These terms do not grant you any rights to it beyond using the service as intended.

Termination¶

You can stop using Embraces and request deletion of your account at any time, as described in our Privacy Policy. We may suspend or terminate your access if you breach these terms, if the law requires it, or if we discontinue the service; where practical, we will give you notice. Sections that by their nature should survive termination (including ownership, disclaimers, liability limits, and indemnity) survive it.

Disclaimers¶

The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate or appropriate.

Limitation of liability¶

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our total liability for all claims relating to the service is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law.

Indemnity¶

You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from the content you create or upload, your use of the service, or your breach of these terms.

Governing law¶

These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over disputes arising from them, except where the law of your country of residence gives you mandatory protections or venue rights that apply regardless.

Changes¶

We may update these terms as the product evolves. Material changes will be announced in-app or by email before they take effect, and continuing to use the service after that means you accept the updated terms. The "Last updated" date at the top of this page always reflects the current version.
